IMHERE Lab – Aerial Expression Studio

1. Scope
These Terms and Conditions (T&C) apply to all services offered by IMHERE Lab, including regular classes, workshops, teacher trainings, and open training sessions at all locations where IMHERE Lab operates.
By booking a class, workshop, or training, the participant agrees to the following terms.
2. Studio Use
a) By registering for a class or workshop, participants are entitled to use the studio facilities during the scheduled class hours. Access is granted 15 minutes before and after class for changing and preparation.
b) All IMHERE Lab classes and programs have limited capacity. Participation is subject to availability and the participant meeting any necessary physical or experience requirements.
c) Participants are expected to treat the studio space and equipment with care, maintain respect toward instructors and fellow students, and follow all safety and hygiene guidelines.
IMHERE Lab reserves the right to deny entry or remove participants from a class in cases of disrespectful behavior, aggression, harassment, theft, or unsafe conduct, without refund.
3. Payment & Cancellations
Payments are processed upon booking.
All class and workshop fees are non-refundable. However, participants may transfer their spot to another person up to 24 hours before class at no extra charge.
Partial attendance does not entitle a participant to a fee reduction unless previously agreed upon (e.g., joining an ongoing course with available spots).
If IMHERE Lab must cancel or postpone a class due to insufficient participants, illness, or unforeseen events, a make-up class will be offered.
4. Health & Safety
Each participant confirms that they are physically healthy and mentally stable, capable of meeting the physical and emotional demands of aerial and movement practice.
Participation under the influence of alcohol, drugs, or medication that affects performance is strictly prohibited.
Participants agree to inform instructors of any injuries, chronic conditions, or health concerns that might affect training. In case of pregnancy, medical clearance must be provided prior to participation.
All movement activities are taken at the participant’s own risk. IMHERE Lab is not liable for accidents or injuries resulting from participation, unless caused by proven negligence of the studio staff.
5. Personal Belongings
IMHERE Lab is not responsible for lost or stolen items.
Participants are encouraged to keep valuables with them during class, as lockers may not be available.
6. Open Training
Open Training hours allow students to practice independently in the studio.
No instructor supervision is provided, but a host may oversee safety protocols.
Participation is permitted only for students who have completed a Safety Introduction Session and are 18 years or older.
7. Media & Documentation
By joining IMHERE Lab classes or workshops, participants agree that photos or videos taken in the studio may be used for educational and promotional purposes (website, social media, flyers, etc.), unless they explicitly request otherwise in writing before the session.
8. Data Protection
Participant data is stored securely and used exclusively for administrative and communication purposes within IMHERE Lab.
No personal information will be shared with third parties.
All data will be handled in compliance with the EU General Data Protection Regulation (GDPR).
9. Jurisdiction & Applicable Law
These Terms and Conditions are governed by Austrian law.
The exclusive place of jurisdiction is Vienna, Austria.
10. Final Provisions
There are no verbal side agreements to these Terms.
Any modifications must be made in writing (email is sufficient).
If any clause of these Terms is found invalid, the remaining provisions shall remain in effect, and the invalid clause will be replaced by one that best reflects its original intent.

11. Force Majeure
IMHERE Lab shall not be held liable or responsible for any delay, cancellation, or modification of classes, workshops, or events caused by circumstances beyond its reasonable control, including but not limited to natural disasters, extreme weather conditions, fire, flood, war, pandemics, government restrictions, strikes, or other acts of force majeure.
In such cases, no refunds will be issued, but IMHERE Lab will make reasonable efforts to offer alternative dates, online options, or class credits whenever possible.
