IMHERE Lab – Aerial Expression Studio
Vienna, Austria

1. Scope and acceptance

These terms apply to regular courses and studio hire offered by IMHERE LAB. Any separate terms for workshops, events, teacher training or online programs will be provided before booking.

2. Studio Use

a) By registering for a class or workshop, participants are entitled to use the studio facilities during the scheduled class hours. Access is granted 15 minutes before and after class for changing and preparation.

b) All IMHERE Lab classes and programs have limited capacity. Participation is subject to availability and the participant meeting any necessary physical or experience requirements.

c) Participants are expected to treat the studio space and equipment with care, maintain respect toward instructors and fellow students, and follow all safety and hygiene guidelines.
IMHERE Lab reserves the right to deny entry or remove participants from a class in cases of disrespectful behavior, aggression, harassment, theft, or unsafe conduct, without refund.

3. Payment & Cancellations

Courses and Workshops:

Payments are processed upon booking.
All class and workshop fees are non-refundable. However, participants may transfer their spot to another person up to 24 hours before class at no extra charge.

Partial attendance does not entitle a participant to a fee reduction unless previously agreed upon (e.g., joining an ongoing course with available spots).

If IMHERE Lab must cancel or postpone a class due to insufficient participants, illness, or unforeseen events, a make-up class will be offered.

Studio hire: cancellations and refunds

Cancellation requests must be sent in writing to the contact email stated in the booking confirmation

  • At least 14 days before the booking begins: 50% of the total agreed hire fee is retained as a cancellation charge; any payment exceeding that amount is refunded.

  • Less than 14 days before the booking begins: the cancellation charge is 100% of the total agreed hire fee; no contractual refund is due.

  • After a block booking begins: cancelling or not using the remaining sessions does not automatically reduce the agreed block fee.

If payments already made are lower than the applicable cancellation charge, the outstanding difference remains payable, subject to applicable law.

Rescheduling is treated as cancellation and a new booking unless IMHERE LAB agrees otherwise in writing.

Cancellation charges remain subject to mandatory law and any required adjustment for saved costs or replacement bookings. IMHERE LAB will not recover more than it is legally entitled to receive.

Hirer responsibilities

The hirer is responsible for organising and supervising their own classes or events, including:

  • Providing appropriately qualified instructors.

  • Ensuring that the activity and participant numbers are suitable for the space.

  • Complying with applicable safety rules, licences and legal requirements.

  • Maintaining any insurance required for their activity.

  • Ensuring participants follow studio rules.

  • Keeping exits clear and observing agreed noise limits.

  • Returning the studio clean and in the agreed condition.

Rigging, aerial equipment, attachment points and studio installations must not be altered or used without express permission. Approval to use equipment does not replace the hirer’s duty to organise safe instruction.

The hirer must report accidents, damage and safety concerns promptly. They are responsible for damage attributable to their culpable conduct or that of persons for whom they are legally responsible. Ordinary wear and tear is excluded.

Keys and access codes must be kept secure and returned or discontinued as agreed.

4. Health & Safety

Each participant confirms that they are physically healthy and mentally stable, capable of meeting the physical and emotional demands of aerial and movement practice.
Participation under the influence of alcohol, drugs, or medication that affects performance is strictly prohibited.

Participants agree to inform instructors of any injuries, chronic conditions, or health concerns that might affect training. In case of pregnancy, medical clearance must be provided prior to participation.

All movement activities are taken at the participant’s own risk. IMHERE Lab is not liable for accidents or injuries resulting from participation, unless caused by proven negligence of the studio staff.

5. Personal Belongings

IMHERE Lab is not responsible for lost or stolen items.
Participants are encouraged to keep valuables with them during class, as lockers may not be available.

6. Open Training

Open Training hours allow students to practice independently in the studio.
No instructor supervision is provided, but a host may oversee safety protocols.
Participation is permitted only for students who have completed a Safety Introduction Session and are 18 years or older.

7. Media & Documentation

By joining IMHERE Lab classes or workshops, participants agree that photos or videos taken in the studio may be used for educational and promotional purposes (website, social media, flyers, etc.), unless they explicitly request otherwise in writing before the session.

8. Data Protection

Participant data is stored securely and used exclusively for administrative and communication purposes within IMHERE Lab.
No personal information will be shared with third parties.
All data will be handled in compliance with the EU General Data Protection Regulation (GDPR).

9. Liability

Participants are responsible for harm caused by their own culpable conduct, including misuse of equipment or failure to follow safety instructions, to the extent provided by applicable law.

Acknowledging the risks of participation does not release IMHERE LAB from its legal duties.

Nothing in these terms excludes or limits liability for personal injury, intentional misconduct, gross negligence or any liability that cannot lawfully be excluded. Participants retain all mandatory statutory rights.

 

10. Safety concerns and defects

Any concern affecting safety or the agreed use of the studio must be reported promptly, with sufficient detail for IMHERE LAB to assess it.

Unsafe activities must stop immediately. Where appropriate, IMHERE LAB must be given a reasonable opportunity to inspect and remedy the problem.

Reporting a concern does not itself determine entitlement to a refund. Any remedy will depend on the circumstances, the agreed service and applicable law. Cancellation charges do not override valid statutory rights relating to defects or non-performance.

11. Cancellations by IMHERE LAB

If IMHERE LAB cancels a course or cannot provide booked studio hours, the amount paid for the cancelled service will be refunded.

An alternative date or credit may be offered, but acceptance is optional.

For partial cancellations, the refund relates to the portion not provided. Any further mandatory legal rights remain unaffected.

12. Statutory withdrawal rights

The cancellation policies above are separate from any statutory right to withdraw from a distance or off-premises contract.

Under Austrian law, certain leisure services booked for a specific date or period are exempt from the statutory 14-day withdrawal right. This exception does not automatically apply to every service offered by IMHERE LAB.

Where a statutory withdrawal right applies, customers will receive the required information and withdrawal form before concluding the contract.

13.Force Majeure

IMHERE Lab shall not be held liable or responsible for any delay, cancellation, or modification of classes, workshops, or events caused by circumstances beyond its reasonable control, including but not limited to natural disasters, extreme weather conditions, fire, flood, war, pandemics, government restrictions, strikes, or other acts of force majeure.

In such cases, no refunds will be issued, but IMHERE Lab will make reasonable efforts to offer alternative dates, online options, or class credits whenever possible.

Any dispute will be subject to the jurisdiction rules established by applicable law.IMHERE Lab — Aerial Expression Studio

14.Applicable law

Jurisdiction & Applicable Law

These Terms and Conditions are governed by Austrian law.
The exclusive place of jurisdiction is Vienna, Austria

These terms are governed by Austrian law, without depriving consumers of mandatory protections applicable to them.

Final Provisions

There are no verbal side agreements to these Terms.
Any modifications must be made in writing (email is sufficient).
If any clause of these Terms is found invalid, the remaining provisions shall remain in effect, and the invalid clause will be replaced by one that best reflects its original intent.
